As a luxury TNC company you skip local county permitting per vehicle and county vehicle inspections — you deal with the State of Florida, and with the state in any other state you operate in.
No county permitting per vehicle
In Florida, the benefit of operating as a luxury TNC company is that state law preempts local licensing of TNCs, so you avoid county permitting per vehicle and county vehicle inspections and deal with the State of Florida instead. Other states regulate differently — some, like New York, license locally — so we scope each state you enter.
Florida Statute 627.748
Under Florida Statute 627.748, a luxury ground transportation network company is a specialized rideshare service regulated under standard TNC law, with specific provisions for high-end for-hire vehicles.
Exclusively for-hire
A luxury ground TNC connects riders through a digital network strictly to drivers operating for-hire vehicles such as limousines and luxury sedans. Taxicabs are explicitly excluded.
State election
An entity can elect to be regulated as a luxury ground TNC by providing written notification to the Florida Department of Financial Services.
Airports, seaports and local business tax
Florida preempts local TNC licensing, but airport and seaport authorities may still require permits, decals and per-trip fees, and you still need an ordinary local business tax receipt where you are based.
Regulatory requirements change and vary by market. We prepare and manage your filings and renewals, but final licensing decisions rest with the state, the county, the airport authority and your insurer, and legal questions should be confirmed with counsel.
